Terms & Conditions
Definitions and Scope

Contract means the agreement between you the Customer and Kertek Plumbing & Heating the Contractor / sole trader for supply of goods and/or services described in an accepted quotation or order.

Works means plumbing and heating services, repairs, installations, tests, inspections and any materials supplied.

These Terms apply to all Contracts for Works unless otherwise agreed in writing by the Contractor.
Quotations, Estimates and Acceptance

Quotations are valid for 30 days unless a different period is stated.

Estimates are indicative and subject to change after site inspection or if unforeseen issues are found.

A Contract is formed only when the Customer accepts the quotation in writing (including messaging), by email, or by paying any required deposit.
Pricing, Deposits and Payment

Price: The quotation sets the price excluding VAT. Kertek Plumbing & Heating is not VAT registered and no VAT will be added.

Deposit: A deposit may be required before work starts. Typical deposits range from 20% to 50% depending on the job.

Payment terms: The balance is due on completion or within the payment period stated on the invoice.

Late payment: Interest and recovery costs may be charged on overdue sums in accordance with the Late Payment of Commercial Debts (Interest) Act.
Variations, Additional Works and Materials

Any work outside the original quotation is a Variation and will incur additional charges. Kertek Plumbing & Heating will notify the Customer and obtain written approval before proceeding where practicable.

The Contractor may substitute materials of equal quality if quoted items are unavailable; any change affecting the price will be notified.
Access, Site Conditions and Health and Safety

The Customer will provide access, utilities and a safe working environment. Additional costs arising from restricted access, unforeseen obstructions or hazardous conditions are chargeable.

The Contractor will comply with applicable health and safety standards. The Customer must inform the Contractor of relevant risks such as asbestos or contaminated water.
Completion, Inspection and Defects

On completion, the Contractor will notify the Customer. The Customer should inspect the Works within 7 days and notify the Contractor of any defects.

The Contractor will remedy defects when notified within a reasonable time, where they result from the Contractor’s workmanship or materials supplied by the Contractor.

These rights are in addition to statutory consumer rights.
Guarantees, Warranties and Manufacturer Terms

Workmanship warranty: Kertek Plumbing & Heating provides a workmanship warranty of 12 months from completion for Works carried out by the Contractor unless a different period is stated in the quotation.

Manufacturer or third-party guarantees apply where specified and are subject to their own terms.
Limitation and Exclusion of Liability

Contractor liability for direct loss caused by proven negligence is limited to the total amount paid under the Contract.

The Contractor is not liable for indirect, special or consequential losses including loss of profits, loss of business, loss of contracts or loss of earnings.

The Contractor is not liable for defects caused by misuse, alteration, neglect, improper maintenance, acts of third parties, or materials supplied by the Customer.

Nothing in these Terms seeks to limit liability for death or personal injury resulting from negligence or any other liability which cannot be legally excluded.
Insurance and Subcontracting

Public liability insurance of £2,000,000. Evidence of insurance will be provided on request.

The Contractor may subcontract any part of the Works but remains responsible for performance and compliance with these Terms.
Materials Ownership and Warranties on Parts

Materials supplied remain the property of the Contractor until payment in full.

Where the Contractor purchases parts on behalf of the Customer, the Contractor acts as the agent and passes on any manufacturer warranties without additional guarantee beyond the workmanship warranty.
Cancellation, Postponement and Call-out Charges

Kertek Plumbing & Heating will refund deposits in full if the Contractor cancels due to inability to perform.

If the Customer cancels within 72 hours of the scheduled start, the deposit may be retained to cover costs and lost time.

Call-out charges apply for attendance, even where no fault is found or access is not provided as agreed.
Complaints Handling and Resolution

Complaints should be raised in writing to kertekheating@gmail.com within 14 days of the issue arising.

The Contractor will acknowledge within 7 days and aim to resolve the complaint within 30 days.

If unresolved, parties will follow the dispute resolution and jurisdiction clause below.
Claims and Legal Costs

If the Customer brings a claim or complaint that the Contractor reasonably considers to be frivolous, dishonest, or vexatious, the Customer will be liable to reimburse the Contractor’s reasonable legal costs and expenses incurred, in defending or responding to that claim. Reasonable legal costs will be assessed on an indemnity basis and may be recovered through the courts.
Dispute Resolution and Governing Law

The Contract is governed by the laws of England and Wales.

Parties will attempt to resolve disputes amicably. If not resolved, disputes will be referred to mediation or the courts depending on the claim value. For claims within the small claims track the Customer may take the matter to the Small Claims Court.
Privacy and Data Protection

Kertek Plumbing & Heating processes personal data only to perform the Contract and in accordance with data protection law. Personal data is used to provide services, issue invoices and comply with legal obligations. Contact kertekheating@gmail.com for privacy questions.
Intellectual Property

All designs, reports and documents produced by the Contractor remain the Contractor’s intellectual property unless paid for in full and otherwise agreed in writing.
Force Majeure

The Contractor is not liable for delay or failure to perform due to events beyond reasonable control, including extreme weather strikes, supply chain disruption, or government action. Performance timeframes will be extended accordingly.
Severability and Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in force.

These Terms together with the Quotation constitute the entire agreement between the parties.
How to Accept These Terms
-
By instructing, making a payment or allowing work to commence with Kertek Plumbing & Heating you accept these Terms.
